Student Fights Back Against RIAA Piracy Charges
A 16 year old student in from White Plains, NY has decided that enough is enough. When the Recording Industry Association of America withdrew their lawsuit against his mother, Patti Santangelo, and aimed its sights on Robert, he decided to fight back.
The lawsuit alleges that Robert has been illegally downloading music since the age of 11, and has been disseminating the music online, but Robert’s lawyer, Jordan Glass has come up with over 30 defenses.
Some of the defenses:
- Robert never shared music with others.
- All music on Robert’s computer was legally owned by store-bought CD’s his sister owned.
- The statute of limitations has passed.
- The average user was never warned transferring music was illegal.
In addition, Glass is demanding a jury trial, and counterclaiming that
- The lawsuit is disturbing the teen’s studies.
- The record companies acting together amounts to collusion.
- The record companies are trying to defraud the courts of the United States.
My Take
I like watching people stand up to the RIAA, I must admit. If Robert defeats the RIAA, their big bark won’t have much effect from here on out against minors.
